The following terms and conditions, in the version valid at the time of the order, apply to all orders placed through this online shop. A consumer within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (\u00a7 13 German Civil Code). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the legal transaction, acts in the exercise of their trade, business or profession (\u00a7 14 German Civil Code).<\/p>\n

\u00a7 3 Conclusion of contract<\/h3>\n

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order. By clicking the order button \u201cOrder with obligation to pay\u201d, you place a binding order for the goods contained in the cart. The contract is concluded when we accept your order by means of an order confirmation by email or by delivering the goods. Receipt of your order is confirmed automatically immediately after submission; this confirmation of receipt does not yet constitute acceptance of the order.<\/p>\n

\u00a7 4 Button solution (\u00a7 312j German Civil Code)<\/h3>\n

Before you submit your order, the essential characteristics of the goods, the total price including all taxes and shipping costs and all other legally required information are displayed to you clearly and comprehensibly. With the button labelled \u201cOrder with obligation to pay\u201d, you confirm your obligation to pay.<\/p>\n

\u00a7 5 Prices and shipping costs<\/h3>\n

All prices are final prices and include statutory VAT. In addition to the stated product price, shipping costs may apply, which are shown separately during the order process. Within Germany, shipping costs are \u20ac4.90; from an order value of \u20ac60 we ship free of charge within Germany. Shipping within the EU from \u20ac9.90. The shipping costs shown during the order process are decisive.<\/p>\n

\u00a7 6 Payment<\/h3>\n

Payment is made via the payment methods offered during the order process (including credit card, Apple Pay, Google Pay, Klarna, SEPA direct debit; for business customers possibly purchase on account). The purchase price is due for payment upon conclusion of the contract unless otherwise agreed. Payment is processed via the payment service provider Stripe.<\/p>\n

\u00a7 7 Delivery<\/h3>\n

Delivery is made to the delivery address you provide. The expected delivery time within Germany is generally 2\u20134 working days, within the EU 5\u20138 working days. Fragrance products containing alcohol are shipped where applicable as a \u201climited quantity\u201d; special shipping conditions may apply to certain countries.<\/p>\n

\u00a7 8 Retention of title<\/h3>\n

The delivered goods remain our property until full payment has been made.<\/p>\n

\u00a7 9 Right of withdrawal<\/h3>\n

Consumers have a statutory right of withdrawal. The details can be found in our Cancellation Policy<\/a>.<\/p>\n

\u00a7 10 Warranty \/ liability for defects<\/h3>\n

The statutory law on liability for defects applies (\u00a7\u00a7 434 ff. German Civil Code). In the event of defects in the goods, you are entitled to the statutory rights. Any guarantees are only binding if they have been expressly declared.<\/p>\n

\u00a7 11 Liability<\/h3>\n

We are liable for damages \u2014 regardless of the legal grounds \u2014 in accordance with the statutory provisions in cases of intent and gross negligence, as well as for injury to life, body and health. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded. Liability under the Product Liability Act remains unaffected.<\/p>\n

\u00a7 12 Dispute resolution<\/h3>\n

We are neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board.<\/p>\n

\u00a7 13 Note for business customers (B2B)<\/h3>\n

The statutory right of withdrawal for consumers and consumer-protection provisions do not apply to orders placed by entrepreneurs. For B2B\/wholesale enquiries, please contact team@akselaroma.com<\/a>.<\/p>\n

\u00a7 14 Final provisions<\/h3>\n

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
