Terms & Conditions

§ 1 Scope

The following terms and conditions, in the version valid at the time of the order, apply to all orders placed through this online shop. A consumer within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the legal transaction, acts in the exercise of their trade, business or profession (§ 14 German Civil Code).

§ 2 Contracting party

§ 3 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order. By clicking the order button “Order with obligation to pay”, you place a binding order for the goods contained in the cart. The contract is concluded when we accept your order by means of an order confirmation by email or by delivering the goods. Receipt of your order is confirmed automatically immediately after submission; this confirmation of receipt does not yet constitute acceptance of the order.

§ 4 Button solution (§ 312j German Civil Code)

Before you submit your order, the essential characteristics of the goods, the total price including all taxes and shipping costs and all other legally required information are displayed to you clearly and comprehensibly. With the button labelled “Order with obligation to pay”, you confirm your obligation to pay.

§ 5 Prices and shipping costs

All prices are final prices and include statutory VAT. In addition to the stated product price, shipping costs may apply, which are shown separately during the order process. Within Germany, shipping costs are €4.90; from an order value of €60 we ship free of charge within Germany. Shipping within the EU from €9.90. The shipping costs shown during the order process are decisive.

§ 6 Payment

Payment is made via the payment methods offered during the order process (including credit card, Apple Pay, Google Pay, Klarna, SEPA direct debit; for business customers possibly purchase on account). The purchase price is due for payment upon conclusion of the contract unless otherwise agreed. Payment is processed via the payment service provider Stripe.

§ 7 Delivery

Delivery is made to the delivery address you provide. The expected delivery time within Germany is generally 2–4 working days, within the EU 5–8 working days. Fragrance products containing alcohol are shipped where applicable as a “limited quantity”; special shipping conditions may apply to certain countries.

§ 8 Retention of title

The delivered goods remain our property until full payment has been made.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. The details can be found in our Cancellation Policy.

§ 10 Warranty / liability for defects

The statutory law on liability for defects applies (§§ 434 ff. German Civil Code). In the event of defects in the goods, you are entitled to the statutory rights. Any guarantees are only binding if they have been expressly declared.

§ 11 Liability

We are liable for damages — regardless of the legal grounds — in accordance with the statutory provisions in cases of intent and gross negligence, as well as for injury to life, body and health. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded. Liability under the Product Liability Act remains unaffected.

§ 12 Dispute resolution

We are neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board.

§ 13 Note for business customers (B2B)

The statutory right of withdrawal for consumers and consumer-protection provisions do not apply to orders placed by entrepreneurs. For B2B/wholesale enquiries, please contact team@akselaroma.com.

§ 14 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence. Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
